1. Introduction

This Privacy Policy describes how Ben & Nino Auto Repair Inc. ("we," "us," or "our") collects, uses, and shares information when you use the TowControl / DriverConnect mobile application (the "App"). TowControl / DriverConnect serves customers requesting towing services and authorized drivers, dispatchers, and administrators managing towing jobs. Staff features include job documentation, navigation, time tracking, and communication with dispatch.

2. Information We Collect

2.1 Information You Provide

• Account Information: Name, email address, phone number, and employee identification
• Profile Information: Driver license information, vehicle assignments, and employment details
• Job Documentation: Photos of vehicles, signatures, notes, and job-related documentation
• Time Tracking Data: Clock-in/clock-out times, work schedules, time-off requests
• Financial Information: Deductions, reimbursements, and payment-related data processed through Square

2.2 Automatically Collected Information

• Location Data: Real-time GPS location when using the App, including during navigation and job completion. Location data is collected both when the App is in use and in the background to enable turn-by-turn navigation and job tracking
• Device and Diagnostic Information: Device model, operating-system version, App version, build number, crash messages, and technical stack traces when an error occurs
• Usage and Business Activity: Job status changes, time and schedule activity, and other actions required to operate the App
• Camera and Selected Media: Photos taken through the App or specifically selected by you for vehicle inspections and job documentation. The Android App does not request broad access to your photo library

3. How We Use Your Information

We use the information we collect to:

• Job Management: Assign jobs, provide navigation, track job status and completion
• Location Tracking: Share your real-time location with dispatch for efficient job assignment and safety monitoring
• Time and Payroll: Track work hours, manage schedules, process time-off requests, calculate deductions and reimbursements
• Communication: Send job assignments, notifications, and updates
• Service Improvement: Analyze usage patterns to improve App functionality and user experience
• Legal Compliance: Maintain records for employment, tax, and legal purposes
• Safety and Security: Monitor for fraudulent activity and ensure workplace safety
• Reliability and Support: Diagnose crashes, investigate support requests, and improve App stability

4. Information Sharing and Disclosure

4.1 Within Our Organization

Your information is shared with:

• Dispatch and management staff for job assignment and coordination
• Payroll and HR departments for employment and compensation purposes
• IT staff for App maintenance and technical support

4.2 Third-Party Service Providers

We share information with:

• Google LLC: For Firebase cloud storage, Google Maps navigation services, and location services
• Square, Inc.: For payment processing and financial transactions
• Apple Inc. and Google LLC: For app distribution and push notifications through the App Store and Google Play Store

These service providers are contractually obligated to protect your information and use it only for the purposes we specify.

4.3 Legal Requirements

We may disclose your information if required by law, court order, or governmental authority, or to protect our rights, property, or safety.

5. Data Retention

We retain information for as long as reasonably necessary for the business purpose for which it was collected and to meet employment, tax, insurance, fraud-prevention, dispute, and other legal obligations. Retention varies by record type:

• Location Data: Retained with relevant job and route records for dispatch, safety, dispute, and legal purposes
• Job Photos and Documentation: Retained with the job record for business, insurance, and dispute purposes
• Time and Payroll Records: Retained for employment, payroll, and tax obligations
• Crash and Diagnostic Records: Retained while reasonably needed to investigate reliability and support issues
• Account Information: Retained while the account is active and afterward where required for legitimate business or legal purposes

You may request deletion of your account and associated personal data at towcontrol.com/account-deletion or from My Profile in the App. We may retain towing, payment, tax, fraud-prevention, employment, and other records when required for legitimate business or legal purposes. Retained records are no longer used to provide account access.

6. Data Security

We implement appropriate technical and organizational security measures to protect your information, including:

• Encrypted data transmission (SSL/TLS)
• Secure cloud storage with Firebase
• Access controls and authentication requirements
• Regular security assessments

However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

7. Your Rights and Choices

7.1 Access and Correction

You may access and update your profile information within the App. For additional access requests, contact eli@towcontrol.com.

7.2 Location Services

You can disable location services through your device settings, but this will prevent the App from functioning properly, as location tracking is essential for job assignment and navigation.

7.3 Push Notifications

You can disable push notifications through your device settings, though this may affect your ability to receive timely job assignments.

7.4 Account Deletion

You may request deletion from My Profile in the App or through our account deletion request page. We verify requests before removing account access and deletable personal data. Business and legal records that must be retained are handled according to the retention terms above.

8. Children's Privacy

The App is intended for customers and authorized staff aged 18 and older. We do not knowingly collect information from individuals under 18.

9. California Privacy Rights

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), including the right to:

• Know what personal information we collect, use, and share
• Request deletion of your personal information (subject to legal and business exceptions)
• Opt out of the sale of personal information (note: we do not sell personal information)

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of material changes through the App or via email. Your continued use of the App after changes become effective constitutes acceptance of the revised policy.

The App is designed for use in the United States. If you access the App from outside the U.S., your information will be transferred to and processed in the United States, which may have different data protection laws than your country.

13. Employment Relationship

This Privacy Policy does not modify your employment relationship with Ben & Nino Auto Repair Inc. or create any contractual rights. For employees, use of staff features is subject to applicable company policies and employment agreements.
